So recently Adobe has been going litigation heavy in protecting its ‘trademarks’. Two sites, namely flashden( http://blog.activeden.net/site-news/important-news-flashden-is-changing-its-name-to-activeden/ ) and freshairpps( http://www.centernetworks.com/adobe-air-freshairapps-trademark ) have been forced by the guys at Adobe’s legal team to change their names to not use ‘flash’ in the domain. Now first I would like to say that if the domain included ‘adobe flash’ or ‘adobe air’, then I would agree with adobe as those should be only usable by adobe. However, the word ‘flash’ is a common term in the english language and should not be trademarkable, especially if you are not using it in conjunction with the adobe logo.
However, most people will fold to adobe because they cannot afford the legal fees associated with challenging adobe. If some of these people actually could put down the attorney fees and challenge adobe, I do not think adobe would come out a winner.
These legal cases have generated much bad publicity for adobe and have made several would-be adobe evangelists give up on the product altogether. I mean why evangelize a product, only to have the company stab you in the back later? Doesn’t make sense. Hopefully some people will switch over from adobe evangelists to evangelists for the competition — that would teach adobe and especially its legal team a lesson.
However, do not blame all adobe employees, many of them loved these community sites and do not agree with this. The people to blame are adobe’s legal team and also the guy who heads the app store at adobe. Apparently, he could not build a store attractive enough for people to visit and so decided the easiest way was to annoy competition.
